Hong Kong's VATP Regime for Crypto Derivatives, Explained

Hong Kong has positioned itself as a regulated gateway for virtual assets, and its VATP (Virtual Asset Trading Platform) regime is now maturing. If you're weighing Hong Kong as a base, the key thing to understand is that its framework is built on securities law — which changes everything for a derivatives venue.
The dual framework
Hong Kong's regime rests on two ordinances supervised by the Securities and Futures Commission (SFC):

The VASP/VATP provisions took effect on 1 June 2023, and as of early 2026 the SFC had licensed 13 VATPs (Fintech Hong Kong, CryptoSlate).
Why derivatives are different here
Under the SFO, derivatives and security tokens are regulated as securities — so a platform touching even a single security token needs both a Type 1 (dealing in securities) and a Type 7 (providing automated trading services) licence (CryptoSlate). This is a different, heavier permission set than a spot-only VA platform.
Client-asset and conduct standards
The SFC's VATP framework is prescriptive on operations: token due diligence, custody standards, cybersecurity, and client-asset segregation. Notably, SFC-regulated VA dealers may only safekeep client virtual assets with SFC-regulated VA custodian service providers — custody isn't something you can improvise (see custody models).
What it means for operators
- Expect securities-grade licensing. A derivatives or security-token venue needs Type 1 + Type 7, not a light-touch VA registration.
- Plan around an evolving derivatives regime. Build on infrastructure flexible enough to adapt as the SFC finalises derivatives/margin rules.
- Custody is regulated separately. Line up an SFC-regulated custodian early.
