Australia's ASIC Crypto Rules & the AFSL Regime

Australia treats crypto derivatives as financial products — so you need an AFSL. Inside ASIC's approach, the new Digital Assets Framework, the 2026 licensing cliff and retail leverage limits.

Australia has quietly become one of the more demanding places to run a crypto derivatives business, because ASIC has long treated crypto derivatives as financial products — which means an Australian Financial Services Licence (AFSL), the same regime that governs traditional finance. In 2026 that net widened to crypto platforms generally, and the timeline is tight.

The new Digital Assets Framework

Australia's Parliament passed the Corporations Amendment (Digital Assets Framework) Act 2026 (Royal Assent 8 April 2026), bringing Digital Asset Platforms and tokenised-custody providers under AFSL licensing (Finance Magnates). ASIC's guidance on how digital assets map to financial products sits in its updated INFO 225 (ASIC).

A small-platform exemption applies (broadly, holding under A$5,000 per customer and under A$10m annual transactions), but any venue offering leverage or derivatives is well outside that.

Derivatives and retail leverage

Crypto derivatives were largely kept outside the new platform-licensing carve-outs — meaning they continue to be treated as financial products requiring the appropriate AFSL authorisations, not swept into a lighter regime. ASIC has also been aggressive on retail leverage: it restricts leverage on crypto-asset CFDs offered to retail clients, and enforcement is real — the local operator of Kraken (Bit Trade) was fined A$8 million in December 2024 over a leveraged "margin extension" product (Finance Magnates).

What it means for operators

  • Assume you need an AFSL. A crypto derivatives venue serving Australians is a licensed financial-services business, full stop.
  • Mind the retail line. Leverage to retail is constrained; a professional/wholesale focus is simpler.
  • Move on timing. The transitional deadlines have largely passed for new entrants — plan a full AFSL path with local counsel.
